    AUDITOR’S EXPERIENCE
    Upon entering the Marin County Sheriff's Office, I asked for the person who handles the public information requests. Legal Process Specialist Scott Licatovich came to the window. I told Scott that would like all the crime and arrest info for burglaries, sexual assaults and robberies occurring between Nov. 1 and Nov. 16, 2006. He asked if I was looking for all those coming through the county jail, or handled by the sheriff's office (i.e. in unincorporated areas) and I said by his department. Scott asked me if I was working on a University project. I said I was working on a project, but not for a university. He didn't ask me any more questions. Scott said I could not see the crime/arrest reports because they ARE NOT public information because they contain personal information. I asked if there was an edited version of the reports that excluded personal information and he said No. He said some requests are granted in cases when the request is "considered reasonable," for example when the requester is somehow involved in the reported incident. He referred by to the crime analysis department, where he said I could obtain crime statistics in the categories I was interested in. I did not go to that office. Next, I asked for a copy of Form 700. He didn't know what that is. After I explained to him what Form 700 is, he said I should inquire with the administration office. I did not go to the administration office. Finally, I gave Scott my written public records request. He said he had no problem accepting, but I should be aware that the information would be coming from multiple departments within the counties. I asked is it OK if I submit the one form and he said yes. He time-stamped my copy and gave me his business card at my request. On Dec. 13, 2006, I received the following e-mail, asking for a 14-day extension: Malaika Fraley Via email: malaika.fraley@gmail.com RE: California Public Records Act Request Dear Ms. Fraley: My office represents the County of Marin. We have received your letter dated December 4, 2006, requesting to inspect records and for records to be copied under the California Public Records Act Section 6250 et seq. You have specifically requested to inspect the following: Most recent record of asset forfeiture fund disbursements. Most recent summary of officer discipline statistics. Copies of whatever document states the fee to be charged for records or reports including:  the names, and addresses of persons involved in, or witnesses other than confidential informants to, the incident, the description of any property involved, the date, time, and location of the incident, all diagrams, statements of the parties involved in the incident, the statements of all witnesses, other than confidential informants, to the victims of an incident, or an authorized representative thereof, an insurance carrier against which a claim has been or might be made, and any person suffering bodily injury or property damage or loss, as the result of the incident caused by arson, burglary, fire, subdivision (c) of Section 13960 . Pursuant to Government Code section 6253, we have determined within the statutorily mandated time of 10 days from receipt of your request that various county departments have in their possession documents which are responsive to your request. In addition, please be advised that additional documents responsive to your request may exist but are subject to exclusion from production under the Public Records Act, such as those subject to the legislative privilege, the attorney-client privilege or the attorney work product privilege. The County is unable to provide any records which contain or relate to such privileges and such information is expressly excluded from the Public Records Act under Section 6254(c)  Personnel, medical, or similar files, the disclosure of which would constitute an unwarranted invasion of personal privacy, and (k),  Records, the disclosure of which is exempted or prohibited pursuant to federal or state law, including but not limited to, provisions of the Evidence Code relating to privilege. Your request as framed may be overly broad such that it could be read to include records containing personal, confidential, privileged and protected information. To the extent any such records exist, they are excluded from disclosure and will not be made available. 14 day time extension to respond The County must invoke the provisions of Section 6253(c) of the Government Code and hereby provides written notice that to reasonably respond to your request, the County needs an extension time for a maximum of 14 days based on the existence of the following unusual circumstances posed by your request. Your request asks for a broad number of documents from many different county departments. Furthermore, the information requested may not be necessarily found in documents. Thus, more time will be needed to determine which department may have the documents, indeed if they do exist. Accordingly, we will respond on December 28, 2006.
